Rapid-IT BV - CHESS EXERCISER - End User License Agreement
Limited Software Warranty; License Agreement, and Information Use Disclosures
This document may be updated from time to time and the latest version will be posted at www.chess-exerciser.com/eula. Your continued use of this Software 30 days after a revised version has been posted constitutes acceptance by you of its terms.

GENERAL
- By downloading, installing, opening or otherwise using Chess exerciser you agree to be bound by these Terms of Service which constitute an agreement with Rapid-IT BV, company number 0896924554, registered in Belgium.

LICENCE
- The Chess exerciser application must be seen as three separated parts working together to fullfill its desired functionality: The compiled "code", that we will be further referred to as the "code", a bundled Java Runtime Environment that will run the "code" and that will be further referred to as the "jre", and separated resource files (executable or not), used by the "code" that will be referred to as the "content".
- When buying a license of the Chess exerciser application, you only pay for the "code". The "jre" and the "content" are provided for free under their separate original license agreement(s).

THE CODE
- The "code" and its usage is licensed, not sold. No title or ownership of the "code" of the Chess exerciser application is being transferred or assigned and these Terms of Service shall not be interpreted as a sale of any rights on that "code". Rapid-IT BV retains all rights, title, and interests to the Chess exerciser "code", including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, or moral rights.
- Subject to the provisions of these Terms of Service, you are granted a non-exclusive, non-transferable, limited, and revocable right and licence to use the purchased or downloaded copy of Chess exerciser's "code" for your personal, non-commercial use. Your licence rights are subject to your compliance with these Terms of Service.
- The term of your licence under these Terms of Service shall commence on the date that you install or otherwise use the Chess exerciser's "code" and ends on the date that you uninstall or otherwise dispose the software of Chess exerciser.
- You are not allowed to distribute or publish derivative works or modifications to the "code" of the Chess exerciser application. But if you still do so, you automatically grant to Rapid-IT BV the irrevocable, perpetual, royalty free, sublicensable right and license under all applicable copyrights and intellectual property rights laws to use, reproduce, modify, adapt, perform, display, distribute and otherwise exploit and / or dispose of the modifications and / or derivative works (or any part of them) in any way that Rapid-IT BV considers appropriate. You also waive and agree never to assert against Rapid-IT BV or its affiliates, distributors or licensors any moral rights or similar rights, that you may have in respect of such modifications and / or derivative works.
- Chess exerciser is not a free software, copy-left or public domain software. The "code" is copyrighted and licensed by Rapid-IT BV and any use of it is subject to the rules stated in these Terms of Service or, if applicable, any express consent of Rapid-IT BV.
- You are not allowed to reverse engineer, decompile, disassemble, copy, transfer or distribute the "code", its hacked or otherwise altered versions, any of its parts or any of the paid content.
- Any commercial use of the "code" is subject to express consent of Rapid-IT BV. For this purpose you can contact us on info@chess-exerciser.com. This does not affect your Video Policy set out below.

THE JRE
- The Chess exerciser application is written using the Java Programming Language. In order to run the "code", you need to provide a valid Java Runtime Environment that will do so. The application is then delivered with a compatible version of the BellSoft Liberica Java Runtime Environment, which is licensed under the GNU General Public License (GPL).
- To check BellSoft Liberica details and updates, please visit https://bell-sw.com/liberica. The full license can also be found in the installation directory of the application, within the DefaultJavaRuntime/jre folder.
- You are free to reuse, redistribute, change or share any piece of the jre described in this "jre" section as long as you continue complying with its specific original license agreement.

THE CONTENT
- The Chess exerciser application is delivered with the following specific content:
- Chess Engine: The Chess exerciser application comes with the version 14.1 of the Stockfish open source UCI compatible Chess engine, which is licensed under the GNU General Public License (GPL).
- Puzzles: The Chess exerciser application comes with puzzles downloaded directly from the Lichess website (https://database.lichess.org/#puzzles). Lichess puzzles are released under the Creative Commons CC0 license. More about the Creative Commons CC0 license here: https://creativecommons.org/share-your-work/public-domain/cc0/
- Openings lines: The Chess exerciser application comes with a default set of opening lines downloaded directly from the Lichess openings project on github: (https://github.com/lichess-org/chess-openings). this content is released under the Creative Commons CC0 license. - end game positions: All end games positions have been extracted from original games downloaded from the ficsgames database (http://ficsgames.org/cgi-bin/download.cgi)
- Pieces images: The Chess exerciser application reuses the images provided by user Colin M.L. Burnett on Wikimedia Commons (https://en.wikipedia.org/wiki/User:Cburnett/GFDL_images/Chess) which are available under the GNU (GENERAL PUBLIC LICENSE) Version 2 License (https://www.gnu.org/licenses/old-licenses/gpl-2.0.txt). The original images might have have been resized and or concatenated together to fit the Chess exerciser application and one new image might have been created to represents the random choosing of the color (white or black).
- Sounds: The Chess exerciser application comes with its own sound library. But those sounds are released under the Creative Commons CC0 license. More about the Creative Commons CC0 license here: https://creativecommons.org/share-your-work/public-domain/cc0/
- You are free to modify, reuse, redistribute, or share any piece of content described in this "content" section as long as you continue complying with their specific original license agreement.

NATURE OF THE APPLICATION
- As for any software, you download, install and use The Chess exerciser application at your own risk. We are not liable for any damage that might be caused to you by downloading, installing and using our software.
- We do recommend that you always run up-to-date antivirus and firewall softwares at all time on your computer whenever you run the Chess exerciser application.
- The application is subject to changes in the future. There's always the possibility of the development of the project being discontinued at any time.

PAYMENTS, ACCESS TO CONTENT
- You get access to the application and all it's resources by buying it from an online store. A single payment is all it takes to obtain the latest version of the full application and unlock any specific features of application.
- Possession of the application entitles you to receive all the future updates to the digital content associated with your membership for free.
- We reserve the right to change the price or modify the content if we feel it is going to be beneficial to our community and for the future of the application.

PURCHASE AND REFUNDS
- There are no additional or hidden fees. You pay once for the product and that is it.
- Refunds are possible using the online store feature by following their process and complying to their conditions.

ONLINE STORES AND DISTRIBUTION SERVICES
- If Chess exerciser is provided through an authorised external online store or other authorised distribution service, these Terms of Service and such provision of Chess exerciser is subject to the additional terms and conditions adopted by that particular online store or distribution service. All such applicable terms and conditions are part of these Terms of Service by this reference and in case of collision with these Terms of Service such applicable terms and conditions shall prevail.

USE OF SERVICE
- The application doesn't contain explicit violence and we believe it is appropriate for children from 8 years old.

VIDEO/STREAMING POLICY
- If you are a valid user of the application, you may use the software for the purpose of creating and/or streaming videos (such as tutorials, walkthroughs, reviews etc.), uploading them on video sharing platforms and monetize those for yourself.
- You are not allowed to extract assets from our content and distribute those separately (e.g. sound effects, graphics, music).
- We reserve ourselves the right to revoke this permission if the video is being used in a way that we see as inappropriate, and reserve the right to takedown such videos.

OTHER
- The materials appearing in the application or on the Chess exerciser website may include technical or typographical errors. We don't warrant that any of the materials are always complete, accurate, or up to date.
- Any legal disputes arising in connection with the application of these Terms of Service shall be resolved in accordance with the law of the Belgium and will be resolved by the competent courts of Hasselt, Belgium.
- Each provision of these Terms of Service operates separately. In the case that any provision of these Terms of Service has been invalid or unenforceable for any reason, this fact does not cause invalidity or ineffectiveness of other parts of the Terms of Service.
- We reserve the right to update these terms at any point in time with immediate effect. Last update was on the 6th of September 2023.
